1. It is the buyer's obligation to fully understand the policies of their selected Email Service Provider (ESP) (e.g., Constant Contact, Mail Chimp, or Internal Platform), including acceptable bounce rates, abuse rates, approval of acquired lists, and other restrictions. Accurate Info Inc is not liable for any abuse complaints, account bans, or other consequences of utilising the email list. Purchased lists may be prohibited by some email service providers. ESP recommendations are available upon request. Additional internal or third-party cleaning, suppressions, or deletions of emails from the given list are not relevant and will not represent the authenticity of the emails. Some third-party or deployment platforms perform their own cleansing, which may delete emails from the list and/or restrict the list from being utilised with that specific source.
2. The data is sold "as is," with no warranties or assurances. To be compensated for cases where a greater bounce rate is observed, the client must submit to the ENTIRE database. Accurate Info Inc may seek information on how the email list was utilized, materials delivered, bounce list, or other data usage conditions. Accurate Info Inc will offer extra records if the bounce rate exceeds. (pending bounce list review).
3. Once the order documents are returned and payment is finalized, the normal processing period for list purchases is 36-72 hours. Accurate Info Inc will contact the customer if the processing time is delayed. The amounts of data purchased/counts received are liable to change during the fulfilment process. Accurate Info Inc will notify the client if supplies are low.
4. Accurate Info Inc provides no assurances or representations about email response, open rates, click through rates, or other email marketing efficiency measurements. Customer undertakes to follow all federal, state, and local laws, including but not limited to those governing the United States. CAN-SPAM legislation or Canadian CASL, and expressly releases NDG from any/all liability resulting from Customer's use of the data given and breach of such laws.
